Can I include notes about my gifts?

Written by Sasha Best

You can definitely add notes to your gifts, however, gift notes form part of your statement of testamentary wishes, which are guiding but not binding, and do not impose an obligation upon your executor. Ultimately, your executor (as your trusted representative) will have regard to those notes, so it is generally best practice to make sure instructions are clear and that your executor understands your wishes. Avoid placing binding instructions in the Notes section, as these are non-binding and serve only as guidance. For complex wishes, consider consulting a lawyer from Safewill-Legal to draft a Customised Will that includes tailored, legally enforceable provisions. This can be done by upgrading to a Customised Will on your Safewill Account.
