You cannot create a Power of Attorney (POA) on someone’s behalf without their knowledge or consent.
For this reason it is strongly recommended that each person create their own Power of Attorney.
If your friend or family member asks you to assist them in completing their POA on the Safewill platform, this is a matter to be decided between the two of you. For this reason, if your friend or family member needs additional support, we recommend adding legal advice alongside the Power of Attorney. This enables them to have a phone call with a specialist estate planning lawyer to discuss their circumstances and provide information as to why another person is involved in the preparation of the document.
This way there will be an independent record of the circumstances of the creation of the POA that can be used in future if needed.
