What if someone I appoint uses the Power of Attorney when I still have capacity?

At Safewill, the Powers of Attorney you create will only come into effect if you lose your decision-making capacity. An Attorney cannot exercise the power given to them by the Power of Attorney unless you no longer have decision-making capacity.

If an Attorney uses the document inappropriately then they will be subject to a legal process and could be charged with an offence.
