How can I minimise the risk of my Will being contested?

If you want to avoid your family ending up in court when you pass away you need to carefully consider how you look after them in your Will. If a child, or any other dependent feels they have been left out or treated unfairly they have a legal right to contest your Will and make a claim to part of your Estate. The only way to avoid a family provision claim is by making sure these dependents feel as though they have received a fair share or 'adequate provision' from your estate.

Safewill is not a law firm and cannot provide advice as to who should benefit from your Will or the likelihood of a family provision claim. If you are unsure whether someone has a claim upon your estate or if you require advice specific to your situation about how to avoid your Will being contested we recommend seeking independent legal advice.
